People's Republic of China Export Controls Overview - IIEI-350

Course Description: This six-week online course provides an overview of the legal framework and the evolution of export controls in the People's Republic of China (P.R.C). The regulatory agency roles of various P.R.C. government bodies and the interdepartmental controls, policies and processes used are reviewed. The broader global export regulatory environments in which the P.R.C. rules and regulations exist are also a topic of discussion.

Prerequisite: None.

Major Course Topics & Course Outcomes

As a result of the group and individual activities included in this course, the student will acquire the following knowledge and skills that can be applied to the workplace:  

PRC Export Compliance System Evolution

  • Break down the evolution of the current PRC export control system

PRC Legal Framework for Export Controls

  • Identify the legal framework in the PRC for export controls

Inter-departmental Control

  • Examine the PRC’s inter-departmental export controls

PRC Regulatory Organizations

  • Recognize the various PRC regulatory organizations

PRC Government’s commitment to export controls narrowly defined to Policy declarations/issues (not implementation issues)

  • Understand that the PRC export controls are narrowly defined policy declarations

Existing Multilateral Export Control Regimens

  • Discuss the multilateral export control regimens in which the PRC is a signator

Nuclear Nonproliferation Treaty (TREATY ON THE NON-PROLIFERATION OF NUCLEAR WEAPONS)

  • Interpret the PRCs stance on the treaty on the non-proliferation of nuclear weapons

Wassenaar Arrangement

  • Assess the PRC’s general position on the Wassenaar Arrangement

UN 1540

  • Understand the United Nations resolution 1540’s position with respect to the PRC.

WTO

  • Discuss how the PRC’s membership in the WTO is partially dependent on the PRC’s stance on export controls
  • Recognize the value of the PRC's WTO membership

Australia Group

  • Interpret the PRC's general views on the Australia Group

Implementing Export Control Regulations

  • Understand the challenges the PRC faces in implementing its export control regulations
